CONSIGNMENT CONTRACT TERMS OF AGREEMENT

Being Owner of said property listed on the Consignment and Sales Agreement, I agree to the terms and conditions stated herein and place boat/motor/trailer on Consignment with Marine Unlimited. Owner must present proof of ownership prior to Marine Unlimited selling boat/motor/trailer. If titles and registration are free and clear, it is strongly recommended that original titles and all documentation remain with Marine Unlimited. If there is a lien, Owner must provide lien holder information.

COMMISSION FEES & OTHER CHARGES/FES

Marine Unlimited charges a commission of 10% or $500.00 whichever is greater of the final agreed sale price. Owner will set their own asking price. Owner agrees to contract with Marine Unlimited for a minimum of 30 days. Refer to Pick-Up Clause. All repair charges and or shipping & handling fees will be taken from funding at time of sale.

FUNDING/PAYMENT FOR SERVICES

On clear titles, once all proper title work & documentation have been acquired and approved by Marine Unlimited funding will be paid within 20 days after the date of sale. LIENHOLDER - if there is a lien against boat, Owner understands and agrees that funding will be delayed, contingent upon receiving all pay-off information i.e. lien holder, telephone number, account number, social security number and PIN if one is associated with said account, in addition Owner is to provide a signed Limited Power of Attorney to enable Marine Unlimited to payoff lien holder. If payoff is less than proceeds from sale of boat, Owner will deliver a check to Marine Unlimited payable to said lienholder. If proceeds are greater than payoff amount, Marine Unlimited will issue Owner a check for the difference. Should Owner fail to comply or cooperate with Marine Unlimited in releasing lien holder information, this contract will service as Limited Power of Attorney to enable Marine Unlimited to pay off lien and acquire titles.

LIABILITY/INSURANCE

Owner must maintain insurance on their boat until sale is complete. Owner understands and agrees that Marine Unlimited will not be held liable for any damages or loss to boat including, but not limited to; fire, theft, natural disaster, vandalism, collision, acts of God or any type of property loss.

CONDITION OF BOAT & ACCESSORIES CLAUSE (Read Carefully)

Owner guarantees that said boat is in good running condition and will pass a lake demonstration. Should mechanical or cosmetic repairs become necessary for Marine Unlimited to sell the boat, Owner will be contacted and held responsible for any and all repairs needed including but not limited to; summarizing, winterizing, gas, batteries, impeller, gaskets, seals, misc. parts, etc in addition to labor. These charges will be deducted from funding. If Owner refuses to have necessary repairs performed in order to get said boat sold, Owner will be asked to pick-up boat & pay accrued pick-up fees. Accessories Clause: All accessories that are to be represented with boat i.e.; stereo faceplate, bimini top, cover, ski’s, wakeboard, tubes, fishing equip, etc.. will need to be with boat at time of sign-in. If Owner opts to keep accessories in his/her possession, there will be calculated shipping charges deducted from funding to cover shipping accessories to buyer. Due to the privacy act, Marine Unlimited will be responsible for handling all shipping and will apply necessary packaging and handling fees as deem necessary.

PICK-UP FEES (Read Carefully)

ALL PICK-UP FEES ARE “EXACT CASH” ONLY – no exceptions!! If Owner picks up boat within the first 30 days from date of sign-in, a cash pick-up fee of $500 will be required. After 30 days if Owner opts to pick up boat, he/she will need to contact our office at 707-585-9717, 48 hours in advance and talk directly with a Marine Unlimited representative to assess pick-up fees/charges, and schedule a pick-up time. The pick-up fees will be $ 100 per month – pro rated from date of sign-in. All pick-up fees are EXACT CASH ONLY! No boat will be released until all fees/charges are paid in full. NOTE: if boat is currently under contract, Owner CANNOT pick up boat. Marine Unlimited has the right to complete sale with buyer – NO EXCEPTIONS. Furthermore, once a sale is finalized and completed, Owner relinquishes all rights to terrminate, dispute contract, take-back or pick-up said boat. Due to Privacy Act, Marine Unlimited will NOT release any buyer or selling information to Owner.

ADVERTISING/MARKETING WHILE CONTRACTED WITH MARINE UNLIMITED

Marine Unlimited ask the Owners To not advertise while under contract. However, if Owner is currently listed with another marketing agency at time of sign – you are to inform Marine Unlimited. In addition you are to contact said agency and change ALL contract information to reflect Marine Unlimited and make sure that asking price is the same as we have listed. If Owner opts to advertise outside of Marine Unlimited without our knowledge, commission fees will increase to 15% or $700 whichever is greater. In the event that Owner fails to comply with these terms and sells boat through an outside source while contracted with Marine Unlimited the fee to pick up boat will be $1000.00 or 12% whichever is greater of the current asking price at time of pickup. Fees to be paid in EXACT CASH ONLY, all fees are to be paid in full before releasing boat from Marine Unlimited premises. NO EXECEPTION!

PRIVACY ACT

Under the Privacy Act and for your safety, Marine Unlimited will not and cannot release customer name, address or phone numbers for any reason. Under no circumstances can we release buyer or owner information. NO EXCEPTIONS.

The signing of this contract gives Marine Unlimited limited power of attorney and the right to act on behalf of owner to sell said property listed on the Consignment and Sales Agreement Form.
